Promo video terms of service
This is a translation for convenience; the Czech version Podmínky služby Promo video prevails.
Provider: Martin Šabata, Velešovice 33, 683 01 Velešovice, Czech Republic, company ID (IČO) 73584088, not a VAT payer (the “provider”). Contact: jsem@martin-sabata.cz.
1. What the service does
1.1 From the customer's materials (documents, photos, logo, texts) or website address and from public sources, the service automatically prepares an animated video with a voice-over, music and optional subtitles (the “video”).
1.2 Before the video file is produced, the customer receives a storyboard (scene previews, voice-over text, a listen to the voice) for approval. The customer may send two comments per video free of charge.
1.3 The voice-over is spoken by a synthetic voice created by artificial intelligence.
2. Order and trial videos
2.1 An order is made by submitting the form and confirming the link sent by e-mail.
2.2 The first two orders per e-mail address and per website are free (trial videos). They require no payment card and create no subscription. A video that cannot be produced for reasons on the provider's side does not count towards the trial videos; an order whose storyboard the customer does not approve does count.
2.3 The provider may refuse an order, in particular when the content of the materials or the video falls into the categories in Art. 5.
3. Monthly plan
3.1 The plan costs CZK 280 a month and includes up to 10 videos per calendar month for at most 3 different websites (the addresses the videos point to). Unused videos do not carry over to the next month.
3.2 The plan starts only when the customer activates and pays for it; it does not start on its own after the trial videos.
3.3 Payment is made in advance by card through the Stripe payment gateway and the subscription renews monthly. The customer can cancel it at any time in the customer portal; the plan then runs until the end of the paid period and does not renew. Paid periods are not refunded.
3.4 If a renewal cannot be paid, the plan remains available for another 3 days and is then suspended.
3.5 For each payment the customer receives an invoice by e-mail, issued in Fakturoid. The provider is not a VAT payer. For the invoice, the customer enters a billing address when paying; a business may state its name and company ID in the order.
4. Delivery and retention
4.1 The finished video (MP4, Full HD) can be downloaded via a link valid for 7 days after completion. The customer downloads the video; once the link expires, a new video requires a new order.
4.2 The customer's materials are deleted together with the video 7 days after the link expires. Details are in the data protection policy.
4.3 Stated preparation times are approximate and not binding deadlines.
5. Customer's obligations regarding materials
5.1 The customer declares that they hold the necessary rights to the uploaded materials, photos and logo, the consent of people shown in photos, and that they are authorised to promote the website and brand for which they order the video.
5.2 Materials and orders must not contain illegal content, fraud, hate, sexual content, gambling, misleading health or financial promises, imitation of another brand, violence, content endangering minors or political campaigning. The provider checks the content and will not produce such an order.
5.3 The customer is responsible for the accuracy of information they provide themselves (in the form, materials or comments).
6. Use of the video
6.1 The customer may use the video without further fees to promote their business, product or service, on websites, social media, in presentations, e-mails and in paid advertising, without time or territorial limits.
6.2 The music in the video was created for the provider under a licence for commercial use, including use as part of a video for the customer; the customer may use it only as part of the video, not separately.
6.3 Illustrative photos from the Pixabay stock library (labelled in the video) are subject to the Pixabay licence; the customer may use them as part of the video but may not sell or distribute them separately.
6.4 The voice-over uses a synthetic voice and the video states this at the end (“AI-generated voice”). The customer may not remove this notice or present the voice as the voice of a real person.
7. Liability
7.1 The provider checks facts against the materials and public sources but cannot rule out inaccuracies (e.g. an outdated figure on a website). By approving the storyboard the customer confirms the content of the video.
7.2 If the finished video is technically defective (e.g. missing sound, corrupted file), the provider will produce it again free of charge on request, provided the request is made while the link is valid.
7.3 The provider's liability for damage is limited to the amount the customer paid for the service in the last 12 months; this does not apply to damage caused intentionally or by gross negligence.
8. Final provisions
8.1 In the order, the customer states whether they order as a business or as a consumer. Art. 9 also applies to consumers.
8.2 These terms are governed by Czech law. The provider may change them; changes are announced to subscribers by e-mail at least 14 days in advance and the customer may cancel the plan as of the effective date.
8.3 These terms apply from 12 October 2026.
9. Special provisions for consumers
9.1 A consumer may withdraw from the plan contract without giving a reason within 14 days of its activation, by e-mail to jsem@martin-sabata.cz, for example using the model form below.
9.2 By activating the plan, the consumer expressly requests that the service start immediately, before the withdrawal period ends. On withdrawal the provider refunds the amount paid, reduced by a proportional part corresponding to the videos produced before withdrawal (Section 1834 of the Czech Civil Code), within 14 days using the same payment method.
9.3 Trial videos are free; withdrawal does not apply to them.
9.4 A consumer may also resolve disputes out of court through the Czech Trade Inspection Authority (www.coi.cz).
9.5 A consumer may claim rights from defective performance by e-mail; for a technically defective video, Art. 7.2 applies.
